Customs law

Globalization is more than just a buzzword for international companies.

Goods are sold worldwide and also bought internationally. This inevitably brings you into contact with the customs authorities.

Without proper customs declarations, problems can arise already at the customs clearance ("commodity stands") or later at a customs audit.

Preferential law

Free trade agreements offer the opportunity to save customs duties on imports of goods into the EU.

When exporting to non-EU countries, there are tariff advantages that give companies a competitive advantage in export markets. 

In order to be able to use these advantages, one must know and correctly implement the legal requirements arising from the preferential agreements.

This includes the determination of the preferential origin of the goods and the issuing of corresponding preferential documents, as well as the form EUR1 or the declaration of origin on the invoice.

The applicable customs tariff number of the goods is a prerequisite for determining the correct list condition for origin determination.

For materials or goods sold in the EU, it is also necessary to control the management of supplier declarations.

Export control

The international security situation and political constraints result in restrictions on the free movement of goods, which are monitored as part of export control.

Businesses, even if they are not active in the armaments sector or other "critical" sectors, must deal with the following issues: products and services subject to authorization, embargoed countries, economic operators listed in sanction lists.

 For international companies u.a. following questions: 
  • Are these areas of law established in your company?
  • Who identifies dual-use goods and uses the correct codes for customs declarations?

authorised economic operator (AEO)

Increasing globalization and the changing of the international security situation have prompted the World Customs Organization (WCO) to create a global framework for modern effective risk management in customs administrations with a "Framework for Standard and Secure and Facilitate Global Trade" (SAFE).
An Authorized Economic Operator (AEO) has a special status: he is considered to be particularly reliable and trustworthy and can benefit from special customs clearance privileges.

Licensing requirements
An Authorized Economic Operator is entitled, subject to the type of authorization, to benefit from numerous benefits in the field of security-related customs controls and simplifications in accordance with customs legislation.

Our support
We support you with the application and for keeping your status (monitoring). The goal of certification should also include improving your operational customs processes. This is not the focus of the Federal Customs Administration. We include this aspect and check your processes for potential weaknesses.
